Clarification Text On The Processing Of Your Personal Data For Employee Candidates

Dear Employee Candidate;

This clarification text has been prepared by Sen Pazarlama Gayrimenkul Anonim Sirketi, acting in the capacity of data controller, in order to inform you about the purposes of and legal reasons for processing your personal data, collection method, to whom it can be transferred and your rights under the PDPL within the framework of the Article 10 of the Personal Data Protection Law No. 6698 (“PDPL”) and the Communiqué on the Procedures and Principles to be Complied with in Fulfilling the Disclosure Requirement.

We do not have absolute control over the information which you have specified in your curriculum vitaes that you have sent to us or on the websites via which you contact with us. We recommend you not to share your personal data and sensitive personal data which you do not want us to know with our Company.

1. Which Personal Data Do We Process?
  • Your name, surname, date and place of birth, gender, marital status, nationality details;
  • Your e-mail address, address, mobile phone number;
  • Information about your health (such as your disability status) if you include it in your curriculum vitae;
  • Your educational background, certificates and diplomas, specialized knowledge, foreign language, skills, seminars and courses that you attended, computer skills, exam results;
  • Information about your work experience (e.g. sectors, companies and positions in which you had previously worked, your responsibilities, your remuneration);
  • Your photo;
  • Your driver's license details;
  • Information about your hobbies;
  • Your salary expectation;
  • Your military service details,
  • Your reference information (name, surname, title, workplace, contact details of the reference person),
  • Other information that you have voluntarily added to your curriculum vitae, but that we cannot foresee

They are processed in accordance with the PDPL.

Your data in question may be kept by Sen Pazarlama Gayrimenkul Anonim Sirketi for up to 1 year if your job application is not approved and up to 10 years after you leave the workplace if it is approved.

2. For Which Purposes Do We Process Your Personal Data?

Your personal data mentioned above is processed for the following purposes for the performance of this Service Contract with regard to the employment service that we provide to you:

  • Managing your job application process,
  • Contacting with you,
  • Determining whether you are adequately qualified for the position that we will propose you,
  • Interviewing with the persons from whom we can get references about you and determining whether you are suitable for the job,
  • Determining the position which you want to work in, your salary expectation, whether you can work in other positions and your employment start date,
  • Determining whether you will be able to use the company vehicles when required,
  • Determining the suitability of your age for the position to be proposed to you and ensuring compliance with the Regulation on the Procedures and Principles for Employment of Child and Young Workers,
  • Your being remembered easily by our human resources department when you come for an interview,
  • Contacting with the employee candidate and preparing the personnel file if the employee candidate is accepted for employment,
  • Determining whether you have a condition that may interrupt your work during the employment contract period and ensuring compliance with the provision of the Article 75 of the Military Penal Code No. 1632.
3. By Which Method and Based on Which Legal Grounds Do We Process Your Personal Data?

The personal data in question is processed by automatic (e.g. sending to your system automatically in the internet environment) or non-automatic (e.g. noting down any information you notified to us by phone) based on the legal grounds (i) “it is mandatory for the data controller to fulfill its legal obligation”, (ii) “data processing is mandatory for the legitimate interests of the data controller, provided that it does not cause harm to the fundamental rights and freedoms of the data subject” and (iii) “it is necessary to process the personal data belonging to the parties to the contract, provided that it is directly related to the establishment or performance of a contract” as set forth in the Article 5 of the Law as subject to your explicit consent.

4. To Whom and For What Purposes Do We Transfer Your Personal Data?

Your personal data may be transferred to our group companies for the purpose of carrying out the human resources operations subject to your explicit consent and evaluating your job application in order to employ you in our other group companies, to the judicial authorities or the relevant law enforcement agencies, if requested, in order to resolve legal disputes or in accordance with the relevant legislation.

5. What Are Your Rights Regarding the Processing of Personal Data and How Can You Access These Rights?

You can send your requests regarding your rights set forth in the Article 11 of the PDPL to SEN PAZARLAMA in written or by using the registered electronic mail (KEP) address, safe electronic signature, mobile signature or the electronic mail address which had been previously notified to the data controller by the data subject and which is registered in the system of the data controller in accordance with the Article 5 of the “Communiqué on the Procedures and Principles for Application to the Data Controller”.
